  1. Promotion

 

This promotion is only open to residents of the United Kingdom (excluding the Channel Islands and the Isle of Man) and Republic of Ireland aged 18 years or over. Proof of age and residence may be required.

 

 

  1. Promoter & Data Controller

 

The Promoter and Data Controller is Muller UK & Ireland Group LLP, a limited liability partnership registered in England with partnership number OC384928 whose registered office is at Shrewsbury Road, Market Drayton, Shropshire TF9 3SQ, United Kingdom. Entries to this address will NOT be accepted.

 

 

  1. Exclusion

 

Promotion excludes employees and their immediate families of: the Promoter or its holding or subsidiary companies; any agencies or suppliers involved with the promotion or its administration; and anyone else professionally connected with the promotion or its administration.

 

 

  1. Final Decision

 

The Promoter’s decision is final on all matters and no correspondence will be entered into.

 

 

  1. Promotional Pot

 

A “Promotional Pot” is a promotional:

     

    1. Cadbury Pots of Joy (4 x 70g pack): Cadbury Dairy Milk, Cadbury Caramel, Strawberries and Crème Limited Edition (available until 31 August 2019) and Screme Egg Limited Edition (available from 1 September 2019)
    2. Cadbury Pots of Joy (2 x 70g pack): Cadbury Dairy Milk, Strawberries and Crème Limited Edition (available until 31 August 2019) and Screme Egg Limited Edition (available from 1 September 2019),

     

 

 

 

each flashed with “Find a cheering pot to win £1,000 and Premier League Tickets!”.

 

 

  1. Promotion Dates

 

The “Promotional Period” opens on 1st August 2019 and closes on 31st October 2019. Promotional Pots are anticipated to be available in participating stores from 1st August 2019 (unless stated otherwise), subject to availability. 

 

 

  1. Unique Reference Number

 

A Unique Reference Number (“URN”) is a 5-digit alphanumeric code, example: L23R5. A URN is printed on the inside of a winning Promotional Pot. If there is no URN or it is not legible inside a winning Promotional Pot, or the winning Promotional Pot does not make a sound, then entrants should contact consumers@muller.co.uk  or the Promoter’s marketing agency by calling the Freephone number shown on the leaflet enclosed in the winning Promotional Pot.

 

 

  1. How to enter – residents in the UK:

 

Before the end of the Promotional Period, entrants must buy a Promotional Pot and peel back the lid. Winning Promotional Pots are: (a) fitted with a special function which will play the sound of a cheering crowd when opened; (b) contain an information leaflet and voucher inside to the value of 1 x 4-pack of Cadbury Pots of Joy; and (c) have a URN printed on the inside of the Winning Promotional Pot. Subject to the successful completion of the prize claim and verification process described in paragraph 11 below, the entrant will win a prize. Entrants must retain their original winning Promotional Pot and lid for verification purposes or this will invalidate their prize win.

 

 

  1. How to enter – residents in Republic of Ireland:

 

Same as above for residents in UK. However, in addition to the prize claim and verification process, in order to win a prize, a Republic of Ireland resident must also correctly answer a qualifying question during their initial phone call with the Promoter’s marketing agency. If the entrant does not answer the question correctly they will not win a prize, and their Promotional Pot will need to be returned to the Promoter using the pre-paid recorded delivery bag which will be provided by the Promoter’s marketing agency. For the avoidance of doubt, no additional winning Promotional Pots will be produced in such circumstances.   

 

 

  1. How to alternatively enter – residents in Northern Ireland:

 

Northern Ireland residents can alternatively enter without purchase by sending their full name, address (including postcode) and telephone number (where you can be contacted in case of being selected as a winner) on a piece of paper to: Cadbury Cheering Pot Promotion, c/o ATOM Marketing, 3 Thorp Street, Macclesfield, Cheshire, SK10 1LJ, UK. Only one entry permitted per stamped envelope. Postal entries must be received by 31st October 2019. Within 5 working days of receipt, or less where the closing date is imminent, the Promoter’s marketing agency will, subject to availability, buy a random Promotional Pot and open it to see if it is a winning Promotional Pot.  Entrants will only be contacted if they are a winner.  

 

 

  1. Prize Claim and Verification Process:

 

 

 

Winning Promotional Pots will contain an information leaflet and voucher inside the pot to the value of 1 x 4-pack of Cadbury Pots of Joy. Entrants must call 0800 433 4715 from the UK (Freephone from landlines and mobiles) or 1800 930 242 from ROI (Freephone from landlines and mobiles) on or before the closing date (31st October 2019) in order to claim their prize. Calls received after the closing date (31st October 2019) will not be accepted. The entrant will hear a recorded message and be asked to leave their name, contact telephone number, address and email address, and quote the URN printed inside the winning Promotional Pot. Within 48 hours of leaving the message (or 72 hours if on a weekend), the entrant will receive a call from the Promoter’s marketing agency and shall be asked to confirm the following verification details: the entrant’s name, address, email address, date of birth, phone number, and the URN printed inside the winning Promotional Pot. ROI entrants will be asked the qualifying question during their initial phone call. If the Promoter’s marketing agency is unable to contact an entrant within 28 days of the Closing Date, this will result in their prize being forfeited and no additional winning Promotional Pots will be produced

 

 

 

Following the initial telephone verification process, the Promoter’s marketing agency will send a confirmation letter and pre-paid recorded delivery bag to the entrant in order for the winning Promotional Pot and lid to be returned by the entrant. Entrants must not send their winning Promotional Pot and lid by any other method, and must not tamper or damage the winning Promotional Pot (including the sound chip) in any way, as doing so will invalidate their prize win.

 

 

 

Once the winning Promotional Pot and lid has been received and validated against the information provided by the entrant above, the entrant will be contacted and awarded a prize. 

 

 

  1. No responsibility

 

The Promoter accepts no responsibility for incomplete or inaccurate entries, or entries or communications that are misdirected, lost, delayed, damaged, corrupted or not received during delivery to or from the Promoter due to any computer malfunction, virus, bug, delay, postal strike, postal issue or other reason whatsoever. Proof of posting is not proof of delivery. All entries become the property of the Promoter. No entries can be returned or copied to the entrant.

 

 

  1. Prizes

 

a)       There will be a total of 20 (twenty) prizes available to be won during the Promotional Period. There is 1 (one) prize for each of the 20 (twenty) winning Promotional Pots.

 

b)       Each prize is:

 

                                             i.            1 x £1,000 (one thousand pounds Sterling) for UK residents or 1 x €1,100 (one thousand one hundred Euro) for ROI residents (“Monetary Prize”); and

 

                                           ii.            2 x Premier League Tickets (general admission only) for a match during the 2019/2020 season (selected matches only, restrictions apply). Travel to the match, accommodation and other costs and expenses associated with the prize are NOT included in the prize.

 

c)       Monetary Prize - This will be given by means of a personal cheque made payable to the winner for the sum of 1 x £1,000 (one thousand pounds Sterling) for UK residents or 1 x €1,100 (one thousand one hundred Euro) for ROI residents. Winners will receive their cheque by recorded post within 28 (twenty eight) days of the Promoter verifying that the person is a valid winner.  Cheques must be cashed within 6 (six) months from the date on the cheque. It is the responsibility of the prize winner to supply the correct personal information for the cheque and current postal address.

 

d)       Premier League Tickets – Within 7 working  days of the Promoter verifying that the person is a valid winner, the winner will be contacted by email by Cadbury FC and they will provide the winner with a link to a ticket portal (“Portal”) and log in details. The winner will need to log onto the Portal and select which match they would like attend within 2 (two) weeks of receiving their email invitation from Cadbury FC otherwise the link will expire and they will not be able to claim their tickets (no alternative prize will be offered).  When the winner logs on to the Portal, they will see a selection of Premier League matches over an 8 week period starting 3 weeks after the winner receives their log in details. It is not possible to change the 8 week period. The winner can select a match from those showing as having tickets available on the Portal. Tickets are available on a first come first served basis and there is no guarantee of tickets being available for a particular match or club. For the avoidance of doubt, the tickets that are available are for home matches only. Away matches are not included. In the event that tickets are not available for the winner’s preferred club, the winner will have the opportunity to select tickets for an alternative club as a neutral fan. It is essential that the winner is a neutral or home fan, and must not select a match where their supported team is playing as the away team. Once they have confirmed their match selection on the Portal and completed their details, the winner will receive an email confirming that they have been allocated a pair of tickets for their chosen match. The tickets will be despatched to the winner during the week of their chosen match. If the winner does not receive their tickets at least 2 (two) days prior to the match they should contact cadburyfc@mktg.com who will arrange for their tickets to be made available for collection by the winner at the stadium where the match is being held (photo ID will be required). By using the Portal, the winner agrees to the Portal’s terms and conditions (available at https://ticketing.cadburyfc.com/CMS/18-19TCs-CadburyFCDomain29.10.pdf). Once the winner has been allocated tickets for their chosen match they cannot be exchanged for an alternative match. The Promoter will not be responsible if the match is delayed, postponed and/or cancelled. Dates and times of matches are subject to change and it is the winner’s responsibility to check the status of their match. The Promoter is not responsible for any costs or expenses associated with the change of time and/or date of a match (for example, reimbursing travel or accommodation costs already incurred prior to the delay, postponement or cancellation) and the winner will be responsible for the costs and expenses associated with travel, accommodation etc for the new time and/or date for their chosen match. The Promoter is not responsible for any lost or stolen tickets. No resale of tickets is permitted. Additional terms and conditions of entry to the game venues may also apply. Please see match tickets for the club’s terms and conditions. The winner and their guest agree to behave responsibly when attending the match, and in line with the terms and conditions specific to that club. The club reserves the right to eject from the stadium any person who fails to comply with applicable terms and conditions of entry.

 

 

  1. Limitations and Non - Transferable

 

The prize in whole or in part is non-transferable. No cash or alternative prize will be offered in whole or in part, except that in circumstances outside of its control, the Promoter reserves the right, at its sole discretion, to substitute or provide a similar alternative prize of equal or greater value (but the Promoter will not be liable to reimburse any travel, accommodation or other costs and expenses already incurred). Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the winner. The Promoter will not be liable for non-delivery of prizes caused by the provision of the wrong information, postal dispute or causes beyond its control.  

 

 

  1. Promotional Pots

 

Winning Promotional Pots must not be sold for commercial gain in any way, including without limitation, on online auction sites. If the Promoter becomes aware that a winning Promotional Pot and/or lid has been made available for sale, bought or sold, the Promoter reserves the right to refuse to redeem the winning Promotional Pot without payment of compensation to the entrant who submits the relevant winning Promotional Pot for verification as a valid claim.

 

 

  1. Unclaimed Prizes

 

If for any reason, none or not all of the 20 (twenty) prizes are claimed by the closing date (31st October 2019), no additional winning Promotional Pots will be produced.

 

 

  1. No liability

 

To the fullest extent permissible by law, the Promoter shall not be liable for any loss or damage whatsoever which is suffered or sustained as a result of participation in the promotion or redemption of the prize or any other loss or damage in connection with or in any way relating to the promotion or a prize.  The Promoter is not responsible for the availability of the Portal and/or any defects or malfunctions in the operation of the Portal howsoever caused which affect the operation of the promotion.

 

 

  1. No Responsibility

 

The Promoter does not take responsibility for, recommend or guarantee the performance of any contractual or other obligations of third parties associated with the prize and shall not be liable for any acts or omissions (including fraud) committed by any third party.

 

 

  1. Publication of Prize Winner

 

By entering the Promotion the entrant agrees that, if they become a prize winner, their first name, county and country may be published by the Promoter on its social media platforms, including Facebook, Twitter and Instagram and in other media at the Promoter’s sole discretion.

 

 

  1. Details of Prize Winners

 

Unless the winner objects, the name, county and country of each prize winner will be available by sending an email request to consumers@muller.co.uk after 16 December 2019 for a period of 3 months. Entries to this address will NOT be accepted.

 

 

  1. Unpaid publicity

 

Prize winners may be required to participate in unpaid publicity as required by the Promoter.

 

 

  1. Disqualification

 

The Promoter reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these terms and conditions (including but not limited to paragraph 15). Entry instructions on-pack, on-line and in any other marketing materials form part of these terms and conditions. All entries must be made directly by the person entering the promotion, and entries made by a third party or with automated devices or processes are not allowed. 

 

 

  1. Verification

 

The Promoter reserves the right to verify any prize claim including, but not limited to, name, address and any winning Promotional Pot and lid. Only valid URN codes will be accepted.

 

 

  1. Right to Suspend, Vary or Cancel

 

The Promoter reserves the right to suspend, vary or cancel the promotion without notice if circumstances make this unavoidable.

 

 

  1. Personal Information

 

The Promoter will collect personal information from the entrant for the purposes of administering this promotion and will share this personal information with the following third parties who will be supporting the Promoter with the promotion:

 

 

 

a.       Promoter’s marketing agency who will help administer the promotion: ATOM Marketing Ltd - a company registered in England with company number 05627228, whose registered office is at 3 Thorp Street, Macclesfield, Cheshire, SK10 1LJ, UK;

 

 

 

b.       Cadbury’s marketing agency responsible for fulfilment of the ticket element of the prize: Dentsu Aegis London Limited, a company registered in England with company number 1939690 whose registered office is at 10 Triton St, Regents Place, London NW1 3BF (“MKTG”);

 

 

 

c.        The company responsible for operating the Portal on behalf of MKTG: The Vantage Point Group Holdings Ltd (trading as Dataflow Events), a company registered in England with company number 03190002 whose registered office is at Fifth Floor, 11 Leadenhall Street, London, EC3V 1LP; and

This includes contacting the winner via phone, email and/or publicising information about the prize winner by post and on social media (as required under clause 19, 20 and 21) in accordance with the privacy policy of the relevant entity.   1. Agreement to Terms and Conditions

 

By entering this promotion all entrants agree unequivocally to be bound by these terms and conditions.

 

 

  1. Severability

 

If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it will be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision will be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause will not affect the validity and enforceability of the rest of these terms and conditions.

 

 

  1. English Law

 

These terms and conditions shall be governed by English law, but is subject to the mandatory local law provisions for consumers. Any dispute shall be subject to the exclusive jurisdiction of the English courts.
