  1. This promotion is only open to residents of the United Kingdom (excluding the Channel Islands and the Isle of Man) aged 18 years or over. Proof of age and residence may be required.

 

  1. Promotion excludes employees and their immediate families of: the Promoter; any agencies involved with the promotion; and anyone else professionally connected with the promotion. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings and their respective spouses), and their respective household members, of the “NBA Entities”, which includes the National Basketball Association (the “NBA”), the NBA Member Teams, NBA Media Ventures LLC, NBA Properties, Inc. and their respective affiliates, subsidiaries, divisions, advertising and promotion agencies are not eligible to enter.

 

  1. The Promoter’s decision is final on all matters and no correspondence will be entered into.

 

  1. The promotion will run for four (4) days in total, over the opening and closing dates set out in the table below (each day being a “Promotional Day”):

  1. Entries received after each of the closing dates and times will not be accepted for that Promotional Day. Entries for a Promotional Day will not be entered into draws for subsequent Promotional Days. Only one entry permitted per person per Promotional Day (i.e. entrants who enter on the first Promotional Day are still able to enter on each of the following Promotional Days).  No payment is required to enter.

 

  1. How to enter: By the closing date and time on a Promotional Day, entrants must retweet the promotional tweet referencing this promotion. No additional comments are required in the tweet. To be deemed a valid entry, the entrant must:

 

  1. Be a follower of @mullerrice (https://twitter.com/mullerrice);

  2. Retweet the promotional tweet that specifically references this promotion from the above account. Entrants do not need to retweet the promotional tweet more than once; and

  3. Not include any other brand names or trade marks; not be defamatory or malicious and not be offensive or use inappropriate language.

     

    Please BE NICE AND KEEP IT CLEAN! The Promoter reserves the right to void any entries that break these rules.

     

  1. On each Promotional Day, one (1) prize winner will be selected at random from all valid entries received by the closing date and time as set out in paragraph 4. There are four (4) prize winners in total, one for each Promotional Day. The winner for a Promotional Day will be announced via the Müller Rice Twitter account after 5pm GMT on that same Promotional Day. The Promoter will direct message the each of the winners on Twitter with instructions on how to receive their tickets. Please ensure that you follow @mullerrice (https://twitter.com/mullerrice) on Twitter so you can receive our direct message. If a prize winner does not respond to the notification of their win within 48 hours of the initial notification, this will result in their prize being forfeited and an alternative winner will be selected based on a reserve chosen at the time of the original selection and under the same terms and conditions as the original selection.  If the further reserve winner does not respond within 24 hours the process will be repeated until an entrant validly claims the prize (but note that no notification of further winners will be made on any bank holiday).  The new prize winner will be notified within 1 (one) working day.

 

  1. The Prize: There are four (4) prizes available. The prize for Promotional Days 1, 2 and 4 consists of two (2) Category B tickets to the NBA London Game 2018 presented by Nike on Thursday 11 January 2018 at the O2 Arena, London (the “Game”), and the prize for Promotional Day 3 is for four (4) Category B tickets to the Game.

 

  1. Tickets for the Game are subject to availability and rescheduling. All expenses and incidental costs not expressly stated in the prize description, including but not limited to travel, lodging, transportation, parking, surcharges, service charges or facility charges, security fees, souvenirs and incidentals, taxes, or other expenses are the responsibility solely of the winners and their guest and are not covered by the Promoter nor the NBA Entities. Neither the Promoter nor the NBA Entities will be responsible if the Game is delayed, postponed, cancelled or rescheduled. No resale of tickets is permitted. There are no whole/part cash alternatives. Additional terms and conditions of entry to the venue may also apply. All prize winners must be over 18 years old, however their guests using the other tickets can be under 18.

 

  1. Prizes will be sent by ‘signed for’ post, on or after the dates shown in paragraph 4.  It is the responsibility of the winners to provide their correct postal address in order to receive their prize. The Promoter nor the NBA Entities accept any responsibility for the loss, misdirection, delay or damage to the tickets during their delivery to the prize winners.

 

  1. The prizes in whole or in part are non-transferable. No cash or alternative prize will be offered in whole or in part, except that in the event of circumstances outside of its control, the Promoter reserves the right to substitute a prize of equal or greater value. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the winners.

 

  1. To the fullest extent permissible by law, the Promoter shall not be liable for any loss or damage whatsoever which is suffered or sustained as a result of participation in the promotion or redemption of the prize. 

 

  1. The Promoter accepts no responsibility for entries that are misdirected, lost, delayed, damaged or corrupted during delivery to or from the Promoter due to any computer malfunction, virus, bug, delay, postal strike, postal issue or other reason whatsoever. All entries become the property of the Promoter.

 

  1. The Promoter does not take responsibility for, recommend or guarantee the performance of any contractual or other obligations of third parties associated with the prize and shall not be liable for any fraud committed by any third party.

 

  1. Subject to paragraph 16 below, the NBA Entities and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, representatives and agents shall have no liability and are hereby released and held harmless by entrants from any claim, action, liability, loss, injury or damage due in whole or in part, directly or indirectly, by any reason, including the acceptance, possession, and/or participation in the promotion.

 

  1. Nothing in these terms and conditions shall limit or exclude the liability of the Promoter or the NBA Entities or of each of the NBA Entities’ respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, representatives and agents for death or personal injury caused by their respective negligence, or the negligence of their respective personnel, agents or subcontractors, fraud or fraudulent misrepresentation; or any other liability which cannot be limited or excluded by applicable law.

 

  1. The name and county of the prize winners will be available by sending a self-addressed envelope to: “NBA Twitter Ticket Promotion, Marketing Department, Shrewsbury Road, Market Drayton, Shropshire, TF9 3SQ” after 31 January 2018 for a period of 3 months. Entries to this address will NOT be accepted.  

 

  1. If it becomes apparent that an entrant is using/has used computer(s) to circumvent these conditions by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified and any prize award will be void.

 

  1. Twitter is not associated with and does not endorse, sponsor or administer this promotion or Müller’s products. Entrants are providing their information to the Promoter and not Twitter. Twitter is not responsible for any element of this promotion.

 

  1. The Promoter is not responsible for the functionality and accessibility of the Twitter website. The Promoter will not be responsible for defects or malfunctions in the operation of the Twitter website howsoever caused which affect the operation of the promotion.

 

  1. The Promoter and NBA Entities reserves the right to right to: verify all entries; disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the terms and conditions; and to refuse to accept any entry where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion. Entry instructions form part of these terms and conditions. 

 

  1. Prize winner may be required to participate in unpaid publicity as required by the Promoter. By entering this promotion, entrants also agree to having their name, Twitter account, and Tweets (or part thereof) published online.

 

  1. By entering the contest and accepting a prize, the winner hereby consents to the reasonable use by the NBA Entities of the winner's photograph, voice, likeness and/or image, contents of the entry form and the name and age of the winner without any further compensation for any future promotional activity.

 

  1. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions at any stage, but will use reasonable endeavours to minimise the effect to participants in order to avoid undue disappointment.

 

  1. The Promoter will collect personal information from entrants for the purposes of administering this promotion and will share this personal information with its marketing agency and/or prize provider who will be supporting the Promoter with the promotion. This includes contacting the winner via direct message and publicising information about the prize winner by post. By entering this promotion, entrants agree to the collection and use of their data in this manner.

 

  1. By entering this promotion all entrants agree unequivocally to be bound by these terms and conditions.

 

  1. If any provision or part provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it will be deemed modified to the minimum extent necessary to make it valid, legal and enforceable.  If such modification is not possible, the relevant provision or part provision will be deemed deleted.  Any modification to or deletion of a provision or part provision under this clause will not affect the validity and enforceability of the rest of these terms and conditions.

 

  1. These terms and conditions shall be governed by English law. Any dispute shall be subject to the exclusive jurisdiction of the English courts.
